South Carolina's guaranty association uses a single $300,000 limit for life insurance, cash values and annuities alike, which is more generous than most states for cash value. The state's insurance department is also in the middle of a high-profile case: in September 2026 it asked a court to place a South Carolina annuity insurer into rehabilitation.

How your policy is protected if an insurer fails

The South Carolina Life and Accident and Health Insurance Guaranty Association (SCLAHIGA) was created by the legislature in 1972. Insurers and HMOs licensed to sell life insurance, health insurance or annuities in South Carolina must be members. When a member company is declared insolvent and ordered liquidated, the association continues coverage, usually by transferring policies to another insurer (which can take 6 to 12 months), or pays claims, funded by assessments on the other members. These limits are from S.C. Code 38-29-40 as quoted on the association's FAQ, checked October 4, 2026.

Coverage Limit
Life insurance death benefit $300,000
Life insurance net cash surrender and withdrawal value $300,000
Annuity (present value, including cash values) $300,000
Health benefit plans $500,000
Disability income $300,000
Long-term care $300,000
Other health insurance $300,000
Overall cap $300,000 per insured life, per insolvent company ($500,000 for major medical)

The cap is per life per failed company. The association's own example: three annuities with one insolvent insurer share a single $300,000 limit, while one annuity at each of three different failed insurers could be protected up to $300,000 each. You keep a claim against the failed company's estate for any amount above the limit. Policies from companies not licensed in South Carolina, fraternal benefit certificates, variable contracts where you bear the investment risk, unallocated annuity contracts and self-insured plans are not covered, and the association can scale back an unusually high guaranteed rate to a figure tied to Moody's corporate bond yields. Generally, it protects people who live in South Carolina when the company is declared insolvent.

Atlantic Coast Life. On September 15, 2026, Insurance Director Michael Wise petitioned the Richland County Court of Common Pleas to place Atlantic Coast Life Insurance Company and Southern Atlantic Re Inc. into rehabilitation, citing concerning signs about their finances. Both are indirectly owned by Advantage Capital Partners, a Miami private equity firm. Rehabilitation is an attempt to repair a company under court supervision; guaranty association coverage is triggered only if a company is later ordered liquidated. The department posts updates and a policyholder FAQ, and policyholders should keep paying premiums meanwhile. See what happens if your life insurance company fails.

Guaranty protection is a backstop, not a reason to buy from a weak insurer. SCLAHIGA is an association of insurance companies, not a state agency, and state law prohibits agents and others from using it in connection with a sale. More in state life and health guaranty associations.

Who regulates life insurance in South Carolina

The South Carolina Department of Insurance, led by a director appointed by the governor, licenses insurers and agents, reviews policy forms, examines insurers' finances, runs an insurance fraud division and handles consumer complaints through its Consumer Services office.

Free look, grace periods and policy rules

  • Free look: S.C. Code 38-63-220 requires every individual life policy to state on its first page that you may return it within at least 10 days of delivery. If the policy replaces other insurance, the period is at least 20 days, and if it was sold by a direct response insurer rather than through a licensed agent, it is at least 31 days. The full premium must be refunded immediately. See the free-look period: returning a policy for a refund.
  • Grace period: at least 31 days for each premium after the first, with the policy in force during that time.
  • Interest and bad-faith fees: if a lump-sum death benefit is not paid within 30 days after proof of death and the necessary claim papers are submitted, the insurer must add interest at the legal rate from the date of death (38-63-80). If an insurer refuses to pay within 30 days of a beneficiary's demand and a court finds the refusal was without reasonable cause or in bad faith, it must also pay the beneficiary's reasonable attorneys' fees (38-63-90).

Taxes, estates and community property

South Carolina has no state estate tax and no inheritance tax. Only the federal estate tax applies, with a $15,000,000 per-person exclusion in 2026 according to the IRS. South Carolina is not a community property state. See state estate and inheritance taxes and life insurance.

Finding a lost policy or unclaimed benefits

Start with the NAIC Life Insurance Policy Locator and the steps in how to find a lost life insurance policy. Life insurance benefits that go unpaid are eventually turned over to the South Carolina State Treasurer's Unclaimed Property Program, which you can search free online. If the insured lived in North Carolina or Georgia, search there as well. More in unclaimed life insurance money and state unclaimed property.
