How your policy is protected if an insurer fails

If a life insurer licensed in Alabama is declared insolvent and ordered liquidated, the Alabama Life & Disability Insurance Guaranty Association (ALDIGA) steps in for Alabama residents. The legislature created it in 1983. Every company licensed to sell life, health or annuity coverage in the state must belong to it, and when one fails the others are assessed to pay covered claims. In practice ALDIGA usually keeps policies in force and tries to move them to a healthy insurer, so you should keep paying premiums while that happens.

These are the maximums ALDIGA lists for insolvencies after July 1, 2012, as of October 4, 2026. They match NOLHGA's national chart (as of June 1, 2025):

Coverage Alabama limit
Life insurance death benefit $300,000 per insured life
Life insurance cash surrender value $100,000 per insured life
Annuities (present value, including cash surrender value) $250,000 per contract owner
Hospital, medical and surgical or major medical $500,000 per insured life
Disability income, long-term care, other covered health $300,000 per insured life
Overall cap $300,000 per person, or $500,000 when hospital and major medical benefits are part of the claim

The annuity cap applies per owner, not per contract. ALDIGA's own example: someone holding three $250,000 annuities with the same failed company is covered for $250,000 in total. Any value above a limit becomes a claim against the failed insurer's estate, which may pay part of it years later. Unallocated annuities, the uninsured part of variable products, and self-funded employer plans are excluded. You are generally covered by the association in the state where you live when the liquidation order is entered, not the state where you bought the policy.

Two cautions. ALDIGA says plainly that it is a private entity, not a state agency. And guaranty coverage is a backstop with limits and delays, not a reason to buy from a weak company. Most states also bar agents and insurers from using guaranty association coverage as a sales pitch, so treat any agent who leans on it as a warning sign. Check an insurer's financial strength ratings before you buy. More on how the system works: state life and health guaranty associations and what happens if your life insurance company fails.

Who regulates life insurance in Alabama

The Alabama Department of Insurance (ALDOI) licenses insurers and agents, reviews policy forms and rates, examines company finances and handles consumer complaints. It also has a Receivership Division (334-240-7560) for insurers placed under court supervision. You can use the department's online company and agent searches to confirm that an insurer or producer is licensed before you buy.

Free look, grace periods and policy rules

  • Grace period: Alabama Code § 27-15-3 requires individual life policies to allow 30 days, or one month of at least 30 days, to pay any premium after the first. The policy stays in force during that time. If the insured dies in the grace period, the insurer can deduct the overdue premium from the death benefit.
  • Free look: Alabama's replacement regulation (Ala. Admin. Code 482-1-133-.06) gives you 30 days after delivery to return a policy that replaces existing life insurance or an annuity, for a full refund of premiums and fees. For a new policy that replaces nothing, the free-look period printed on the policy's cover page controls. See the free-look period: returning a policy for a refund.

Taxes, estates and community property

Alabama has no state estate tax and no inheritance tax. Only the federal estate tax can apply, and its 2026 basic exclusion is $15,000,000 per person, according to the IRS. Alabama is not a community property state, so a spouse has no automatic ownership share of a policy bought with marital income. The named beneficiary generally controls who gets paid.

Finding a lost policy or unclaimed benefits

Start with the NAIC Life Insurance Policy Locator, which ALDOI links from its consumer page as its life and annuity policy search. Participating insurers search their records for a deceased person's policies and contact the beneficiary directly if they find one. Then search the Alabama State Treasury's unclaimed property database at unclaimed.alabama.gov. The Treasury lists insurance proceeds among the kinds of property it holds, and searching and claiming are free. Our guides to how to find a lost life insurance policy and unclaimed life insurance money and state unclaimed property cover old paperwork, bank records and employer plans.

Where to get help

  • Alabama Department of Insurance, Consumer Services: 800-433-3966 or 334-241-4141, [email protected], aldoi.gov
  • File a complaint: first try to resolve the problem with the insurer or agent. If that fails, use the online consumer complaint form. Include your policy number, any claim number, the company and agent names, and a clear description. ALDOI sends the complaint to the company, which must respond, and it can require corrective action. It cannot act as your lawyer or step into a pending lawsuit. See how to file a complaint against a life insurer.
