How your policy is protected if an insurer fails

The Idaho Life & Health Insurance Guaranty Association was created by the Idaho Legislature in 1977. Every insurer licensed to sell life insurance, health insurance or annuities in Idaho must belong to it. If a member company fails, the association protects Idaho residents' covered policies, paid for by assessments on the other members. Usually a financially sound insurer takes over the policies. Sometimes the association continues them directly or works out a plan with other states' associations. Keep paying premiums.

Limits from the association's FAQ, as of October 4, 2026, consistent with NOLHGA's chart (as of June 1, 2025):

Coverage Idaho limit
Life insurance death benefit $300,000
Life insurance net cash surrender or withdrawal value $100,000
Annuity net cash surrender or withdrawal value $250,000
Major medical $500,000
Other health, disability and long-term care benefits $300,000
Health and long-term care cash values $100,000
Overall cap $300,000 per life for all benefits, including cash values ($500,000 for major medical)

Idaho states its limits per policy or contract, with the $300,000 aggregate as the overall ceiling. The association's own example shows how that works. Someone with two $200,000 annuities at the same failed insurer would be protected for $300,000 in total, not $400,000. The rest could be filed as a claim in the receivership.

The association is a private entity, not a state agency. Idaho law prohibits agents and insurers from using it in advertising or solicitation. In the association's words, it is no substitute for choosing a well-managed, financially stable company. Guaranty coverage is a backstop with limits and delays. See state life and health guaranty associations and what happens if your life insurance company fails.

Who regulates life insurance in Idaho

The Idaho Department of Insurance licenses insurers and producers, enforces Title 41 of the Idaho Code, monitors company finances and helps consumers through its Consumer Affairs staff. The department also houses the State Fire Marshal and SHIBA, Idaho's free Medicare counseling program.

Free look, grace periods and policy rules

Idaho's 20-day free look is longer than the 10 days many states require.

  • Free look: Idaho Code § 41-1935 gives you 20 days after delivery to return a life insurance policy or annuity for a refund of the premium, for any reason. The notice must appear on the face page of the policy. See the free-look period: returning a policy for a refund.
  • Grace period: Idaho Code § 41-1904 requires a grace period of 30 days, or one month of at least 30 days, for premiums due after the first policy year. The policy stays in force during the grace period. The insurer may charge interest of up to 6% a year for the days used, and it can deduct unpaid premium from a claim that arises during the grace period.

Taxes, estates and community property

Idaho has no state estate tax and no inheritance tax. Only the federal estate tax can apply, with a $15,000,000 per-person exclusion in 2026, according to the IRS.

Idaho is one of the nine community property states listed in IRS Publication 555. Property acquired during marriage is generally owned equally by both spouses, and that can include a life insurance policy bought with marital earnings. If community funds paid the premiums and the policy names someone other than the spouse as beneficiary, the surviving spouse may have a claim to part of the proceeds. A written spousal consent or a clear property agreement helps avoid disputes. See community property states and life insurance and ask an Idaho estate attorney about your situation.

Finding a lost policy or unclaimed benefits

Submit a free request through the NAIC Life Insurance Policy Locator. Participating insurers search their records and contact the beneficiary if they find a policy. Then search Idaho Unclaimed Property, the official state site, for life insurance proceeds that were turned over to the state, and search the states where the deceased lived before. Our guides to how to find a lost life insurance policy and unclaimed life insurance money and state unclaimed property cover more leads.
