How your policy is protected if an insurer fails

If a life or health insurer licensed in Nevada fails and is ordered liquidated, the Nevada Life & Health Insurance Guaranty Association steps in for Nevada residents who own its policies and annuities. It usually arranges for a healthy insurer to take over the policies or continues them itself, subject to the limits in Chapter 686C of the Nevada Revised Statutes. The association's office is in Roseville, California, but it covers Nevada residents. Keep paying premiums so the coverage stays in force.

Coverage (per individual) Nevada limit
Life insurance death benefit $300,000
Life insurance cash surrender or withdrawal value $100,000
Annuities and structured settlement annuities (present value) $250,000
Government retirement plan participants (unallocated annuity) $250,000
Health benefit plans $500,000
Disability income and long-term care $300,000
Other health insurance $100,000
Overall cap $300,000 for life and annuity benefits ($500,000 including health benefit plans)

Limits are as of October 4, 2026, from the association's FAQ. The most the association will pay for one person's life insurance, annuities and structured settlements with a single insurer is $300,000; adding health benefit plan claims raises the cap to $500,000. The annuity limit applies per owner per company, so three $100,000 annuities with the same failed insurer are protected for $250,000 in total, and the excess becomes a claim in the receivership.

The association is a private entity created by the legislature, not a state agency. Nevada law prohibits agents and companies from using it in advertising or as an inducement to buy, and it is no substitute for choosing a well-managed, financially stable insurer. See state life and health guaranty associations and what happens if your life insurance company fails.

Who regulates life insurance in Nevada

The Nevada Division of Insurance licenses insurers and producers, reviews rates and forms, and has a Consumer Services and Investigations Section that investigates complaints. Call 888-872-3234 toll-free, (775) 687-0700 in Carson City or (702) 486-4009 at the Las Vegas office, 3300 W. Sahara Avenue, Suite 275.

Free look, grace periods and policy rules

  • Free look: a new life insurance policy or annuity must let you surrender it with a written cancellation request within 10 days of delivery and get back any premium, including policy fees. If the policy replaces existing coverage, the window is 30 days (NRS 688A.165). Industrial life policies are excluded. See the free-look period: returning a policy for a refund.
  • Grace period: you have 30 days, or one month of at least 30 days, to pay any premium after the first while the policy stays in force. The insurer may charge interest of up to 6% a year for the days used, and an overdue premium can be deducted if a claim arises during the grace period (NRS 688A.060).
  • Paying death claims: settlement is due on receipt of proof of death, and if the policy sets a deadline, it cannot be longer than two months after the insurer receives those proofs (NRS 688A.140).

Taxes, estates and community property

Nevada has no state estate tax and no inheritance tax. Only the federal estate tax can apply, with a $15,000,000 exclusion per person in 2026. See state estate and inheritance taxes and life insurance.

Nevada is one of the nine community property states listed by the IRS. Property and earnings acquired during the marriage are generally owned equally by both spouses. That matters for life insurance: if premiums on a policy owned by one spouse were paid with community funds, the other spouse may have a claim to part of the policy or its proceeds, especially if someone else is named beneficiary. Before naming a beneficiary other than your spouse, read community property states and life insurance and consider a Nevada attorney's advice.

Finding a lost policy or unclaimed benefits

Search bank statements, mail and tax records for premium payments, ask past employers about group coverage, and use the free NAIC Life Insurance Policy Locator. Benefits nobody claims are eventually turned over to the Nevada State Treasurer's Office, which runs the state's unclaimed property search at NVUP.gov. If the insured lived or worked in California, Arizona or Utah, check those states too. See how to find a lost life insurance policy and unclaimed life insurance money and state unclaimed property.
