How your policy is protected if an insurer fails

Arizona does things a little differently. Its safety net, the Arizona Life & Disability Insurance Guaranty Fund, is administered through the state Department of Insurance and Financial Institutions (DIFI) rather than by a stand-alone private association. The job is the same as elsewhere: when a member insurer licensed in Arizona is found insolvent, the fund pays covered claims and continues covered policies for Arizona residents, financed by assessments on other licensed insurers. Keep paying your premiums while that happens.

Limits as of October 4, 2026, from DIFI's published fund information and NOLHGA's national chart (as of June 1, 2025), with the overall cap from the NAIC's summary of state guaranty laws:

Coverage Arizona limit
Life insurance death benefit $300,000
Life insurance cash surrender or withdrawal value $100,000
Annuities (present value, including cash surrender and withdrawal values) $250,000
Health benefit plans $500,000
Disability income and long-term care $300,000 each
Other health coverage $100,000
Overall cap $300,000 per person, or $500,000 when health benefit plan benefits are involved

Each limit is the lesser of the policy's own value and the statutory figure. Values above the limits become claims against the failed company's estate. Unallocated annuities, such as some employer retirement-plan contracts, are not covered.

Even though DIFI administers the fund, it is not a deposit guarantee like FDIC insurance, and it has limits and can involve delays. It is a backstop, not a reason to pick a weak or unrated insurer. Most states, through their guaranty laws, prohibit agents from using guaranty coverage to sell policies, so be wary of any pitch that does. The fund's contact line is 602-364-3863. Who regulates life insurance in Arizona

The Arizona Department of Insurance and Financial Institutions licenses insurers and agents, reviews policy forms, monitors solvency and handles complaints. It was formed by merging the Department of Insurance with the Department of Financial Institutions. Its consumer services staff take questions and complaints about life insurers, agents and claim handling.

Free look, grace periods and policy rules

  • Grace period: A.R.S. § 20-1203 requires a 30-day grace period, or one month of at least 30 days, for every premium after the first. Coverage continues during it, and an unpaid premium can be deducted if a claim arises.
  • Free look: Arizona's statutes do not set a general return period for a new life policy, so check the notice on your policy's first page. When a new policy or annuity replaces existing coverage, A.R.S. § 20-1241.05 requires the insurer to tell you that you can return it within 30 days of delivery for a full refund. For annuities, § 20-1233 sets a 10-day period, extended to 30 days if the owner is 65 or older on the application date. See the free-look period: returning a policy for a refund.
  • Claim payment: Under A.R.S. § 20-1215, if a policy sets a deadline for paying a death claim, it cannot exceed two months after the insurer receives proof of death. A.R.S. § 20-462 adds interest at the legal rate on first-party claims not paid within 30 days after the insurer receives an acceptable proof of loss. Interest runs from the date the claim was received.

Taxes, estates and community property

Arizona has no state estate tax and no inheritance tax. The federal estate tax exclusion is $15,000,000 per person in 2026, according to the IRS.

Arizona is one of the nine community property states listed in IRS Publication 555. Property acquired during marriage, including a policy bought or premiums paid with wages earned during the marriage, is generally owned equally by both spouses. Naming someone other than your spouse as beneficiary of a policy paid for with community funds can therefore invite a claim by the surviving spouse. Couples sometimes handle this with a written spousal consent to the beneficiary designation, and divorce or remarriage makes the question harder. See community property states and life insurance and ask an Arizona estate attorney about your situation.

Finding a lost policy or unclaimed benefits

Submit a free request through the NAIC Life Insurance Policy Locator. Participating insurers search for policies on the deceased and contact the beneficiary if they find one. Then search the Arizona Department of Revenue's unclaimed property database. Life insurance proceeds that an insurer cannot deliver are eventually turned over to the state, and claiming them from the state is free. Our guides to how to find a lost life insurance policy and unclaimed life insurance money and state unclaimed property cover the rest of the search.
