How your policy is protected if an insurer fails
The New Mexico Life Insurance Guaranty Association was created by the legislature in 1978 to protect New Mexico residents who own policies and annuities issued by a member insurer that becomes insolvent. When that happens, the association usually transfers the policies to a healthy insurer or keeps them in force itself, and the cost is covered by assessments on the other member insurers. Keep paying premiums so your coverage continues.
| Coverage | New Mexico limit |
|---|---|
| Life insurance death benefit (per insured life) | $300,000 |
| Life insurance cash surrender or withdrawal value | $100,000 |
| Allocated annuities (present value, per insured life) | $250,000 |
| Hospital, medical and surgical insurance | $500,000 |
| Disability income insurance | $300,000 |
| Long-term care insurance | $300,000 |
| Other health insurance | $100,000 |
| Overall cap per individual | $300,000 ($500,000 for hospital, medical and surgical insurance) |
Limits are as of October 4, 2026, from the association's FAQ. Benefits from all policies of the same type with the failed insurer are added together before the limits apply. Unallocated annuities are covered up to $250,000 per plan participant and $5,000,000 per contract owner, and one owner of multiple non-group life policies, such as a business, is capped at $5,000,000. Three $100,000 annuities with the same insolvent insurer are protected for $250,000 in total; the rest becomes a policyholder claim in the receivership.
The association is a private entity, not a state agency; its members are the life and health insurers licensed in New Mexico. It provides limited coverage and is no substitute for choosing a well-managed, financially stable insurer, and most states prohibit agents from using guaranty coverage as a sales pitch. See state life and health guaranty associations and what happens if your life insurance company fails.
Who regulates life insurance in New Mexico
The Office of Superintendent of Insurance (OSI) licenses insurers, agents and adjusters and regulates the market. Its Consumer Assistance Bureau helps people with problems involving insurance companies, agents and adjusters operating in New Mexico. Call 855-427-5674 toll-free. Mail goes to P.O. Box 1689, Santa Fe, NM 87504-1689; the office is at 1120 Paseo de Peralta in Santa Fe.
Free look, grace periods and policy rules
- Grace period: individual life policies must allow 30 days, or at the insurer's option one month, to pay any premium after the first, and the policy stays in force during that time (NMSA §59A-20-4).
- Free look: a policy that replaces existing life insurance carries a 30-day free look under OSI's replacement rule (NM ADC 13.9.6.10), according to the NAIC's state chart of life insurance disclosure rules. We could not confirm the minimum for other new individual policies, so check the notice on your policy. See the free-look period: returning a policy for a refund.
Taxes, estates and community property
New Mexico has no state estate tax and no inheritance tax. Only the federal estate tax can apply, with a $15,000,000 exclusion per person in 2026. See state estate and inheritance taxes and life insurance.
New Mexico is one of the nine community property states listed by the IRS. Earnings and property acquired during the marriage are generally owned equally by both spouses. If one spouse owns a policy bought with community funds and names someone other than the other spouse as beneficiary, the spouse may have a claim to part of the policy or its proceeds. Divorce, remarriage and blended families make this more complicated; read community property states and life insurance and consider a New Mexico attorney's advice before naming a non-spouse beneficiary.
Finding a lost policy or unclaimed benefits
OSI points families to the NAIC Life Insurance Policy Locator, a free and confidential tool: participating insurers search their records, and if they find a match they contact the beneficiary. Also check bank statements, mail and tax records for premium payments. Benefits that go unclaimed are turned over to the state, and the New Mexico Taxation and Revenue Department runs the unclaimed property search. If the insured lived or worked in Texas, Arizona or Colorado, search those states too. See how to find a lost life insurance policy and unclaimed life insurance money and state unclaimed property.
