How your policy is protected if an insurer fails
The Missouri Life & Health Insurance Guaranty Association protects Missouri residents who own covered life insurance, health insurance and annuity contracts when a member insurer becomes insolvent. It shares a website, moiga.org, with Missouri's property and casualty guaranty association. The association usually arranges for another insurer to take over the failed company's policies or continues them itself, subject to the limits in RSMo 376.717. Keep paying premiums while that happens.
| Coverage (per insured life) | Missouri limit |
|---|---|
| Life insurance death benefit | $300,000 |
| Life insurance cash surrender or withdrawal value | $100,000 |
| Annuity cash or surrender value (present value) | $250,000 |
| Health benefit plans (major medical) | $500,000 |
| Disability income insurance | $300,000 |
| Long-term care insurance | $300,000 |
| Other health coverage | $100,000 |
| Overall cap | $300,000 ($500,000 when health benefit plan claims are involved) |
Limits are as of October 4, 2026, from the association's Life and Health page and RSMo 376.717, and apply to insolvencies on or after August 28, 2013. They are applied per insured life per insolvency. Each payee of a structured settlement annuity is covered up to $250,000 in present value, and corporate-owned life insurance is capped at $5 million in total per owner. Anything above the limits becomes a claim against the failed insurer's estate.
A guaranty association is not a government agency; its costs are paid by assessments on the other insurers licensed in the state. It is a backstop, not a reason to buy from a financially weak company, and most states prohibit agents from using it as a sales pitch. For background, see state life and health guaranty associations and what happens if your life insurance company fails.
Who regulates life insurance in Missouri
The Missouri Department of Commerce and Insurance (DCI) licenses insurers and producers, examines companies, reviews policy forms and investigates consumer complaints. Its Insurance Consumer Hotline is 800-726-7390, and its home page links to the NAIC Life Insurance Policy Locator.
Free look, grace periods and policy rules
Missouri's free look is set by regulation: 10 days for life insurance and annuities, with some exceptions (20 CSR 400-1.010), and 30 days for a policy that replaces existing life insurance or an annuity (20 CSR 400-5.400), according to the NAIC's state chart of life insurance disclosure rules. We could not confirm the statutory minimum grace period, so check your policy or ask DCI's hotline. See the free-look period: returning a policy for a refund.
Two Missouri rules stand out:
- Suicide clause: a Missouri life policy may exclude suicide only within one year of the issue date, shorter than the two-year exclusion common in most states. If the exclusion applies, the insurer must promptly refund the premiums paid for the excluded coverage. When you add or increase coverage later, a new one-year exclusion can apply only to the added amount (RSMo 376.620). If you or someone you know is struggling, call or text 988 (Suicide & Crisis Lifeline).
- Vexatious refusal to pay: if an insurer fails or refuses for 30 days after due demand to pay a claim and a court finds the refusal vexatious and without reasonable cause, the court may award damages and attorney's fees on top of the amount due and interest (RSMo 375.296 and 375.420).
Taxes, estates and community property
Missouri has no state estate tax and no inheritance tax. Only the federal estate tax can apply, with a $15,000,000 exclusion per person in 2026 under Public Law 119-21, the 2025 tax law known as the One Big Beautiful Bill Act. See state estate and inheritance taxes and life insurance.
Missouri is not a community property state.
Finding a lost policy or unclaimed benefits
Search the deceased's bank statements, mail and tax records for premium payments or policy statements, ask former employers about group life coverage, and file a free request through the NAIC Life Insurance Policy Locator. Money insurers can't deliver eventually goes to the Missouri State Treasurer's Office, which holds more than $1.5 billion in unclaimed assets and never charges to return them. If the insured lived or worked across the state line in Kansas or Illinois, search those states too. See how to find a lost life insurance policy and unclaimed life insurance money and state unclaimed property.
